Africa and Middle East Regional Conference Programme

Day 1: 

Day one of the conference will look at how FIDIC contracts are being used across the region and hear from leading industry experts on the latest developments with FIDIC’s contracts suite. The first session will be followed by three discussion tables where delegates will have an opportunity to discuss FIDIC Golden Principles, receive an update on how the long-term effects of the Covid pandemic are affecting construction projects and on the latest dispute resolution trends in the region. 

A certificate of attendance will be provided to each conference participant which may be used for CPD verification in your local region.

The Covid pandemic had a global impact on the delivery of construction projects across the world. Many of those projects are being delivered under FIDIC standard forms of contract. This session will discuss the long-term effects of the pandemic on construction projects and consider some of the likely scenarios that are arising as a consequence of Covid-19. Delegates will also learn about how parties to a FIDIC contract can consider mutually satisfactory solutions and avoid disputes arising between them.

Heavily amended FIDIC contracts result in contracts that no longer reflect FIDIC principles. Speakers will discuss the FIDIC Golden Principles, which set out the essential characteristics of its general conditions of contract that should not be amended if the contract is to be regarded as a genuine FIDIC contract. These Golden Principles identify which contractual principles of each form of contract FIDIC considers to be inviolable and sacrosanct.

Global supply chains supporting the rise of renewable energy and energy storage include mining and processing of minerals that are often linked to forced labour.  To support forced labour risk mitigation, companies need to strengthen related procurement processes by including forced labour bidder declarations, qualification requirements and strengthened contractual provision in procurement. As a key recent example, the World Bank has enhanced its Standard Procurement Documents to require its borrowers to strengthen procurements involving solar panels/solar components. The panel will discuss the issues arising in the renewable energy supply chain and ongoing industry efforts to mitigate those risks, and protect the workers globally supporting the energy transition.

Dr. Bunni is a Chartered Engineer, Registered Chartered Arbitrator, Conciliator/Mediator, Adjudicator and Visiting Professor in Construction Law and Contract Administration at Trinity College Dublin. He is Past President of the Association of Consulting Engineers of Ireland (1987/1988); of the Chartered Institute of Arbitrators, world wide (2000/2001), and Past Chairman of its Irish Branch (1986/1989); Past Chairman of FIDIC’s Standing Committee on Professional Liability and its Task Committee on Construction, Insurance and Law. He was awarded the SCL Medal for his significant contribution to furthering the Society’s aim of promoting the study and understanding of construction law amongst the industry.

Since 1972, Dr. Bunni has acted as arbitrator, conciliator/mediator or dispute adjudication board member on cases involving parties from over 50 jurisdictions. As arbitrator, he has acted as sole arbitrator; member of tribunal; or chairman (president) of tribunal, in over 155 domestic and international cases, under the Rules of Arbitration of: the ICC; UNCITRAL; LCIA; CRCICA; DIAC, IEI; or ad hoc rules.
