Americas Regional Conference Programme

Day 1:

Day one of the conference will look at how FIDIC contracts are being used across the region and hear from leading industry experts on the latest developments with FIDIC’s contracts suite. Delegates will also hear about the use the FIDIC Silver Book for EPC contracts and the Emerald Book for underground work. 

A certificate of attendance will be provided to each conference participant which may be used for CPD verification in your local region.

Speakers will explain how FIDIC’s innovative Emerald Book contract for underground work deals with complex technical projects. The difficulty in predicting ground behaviour and foreseeable conditions implies an inherent uncertainty in underground construction, which gives rise to unique contractual risks regarding construction practicability, time and cost. The Emerald Book addresses many of these issues and offers a way forward for contracting on such projects.

This session will take an overview of the 2017 Second Edition of the FIDIC Silver Book which maintains the principles of risk sharing established in the 1999 edition, while seeking to build on the substantial experience gained from its use over the past 18 years. Speakers will discuss some of the key changes in this Second Edition including the greater detail and clarity on the requirements for notices and other communications, provisions to address Employers’ and Contractors’ claims treated equally and separated from disputes, mechanisms for dispute avoidance and the detailed provisions for quality management and verification of contractor’s contractual compliance.

Day 2:

Day two of the conference will hear from clients on their experiences of working with FIDIC forms on IFI-funded contracts and also from legal and contractual experts who will consider the contractual aspects and implications of working with FIDIC contracts in the region.

Speakers will look at FIDIC Suite of Contracts 1999 and 2017 Editions and how they are used on various projects across the world, including the projects funded by IFIs. Principal drafter of the 2017 update will highlight the changes and updates between two editions and enable delegates to learn about and understand the similarities and new provisions applicable to these FIDIC standard forms of contracts. Speakers will also highlight the role of the dispute boards.

Global supply chains supporting the rise of renewable energy and energy storage include mining and processing of minerals that are often linked to forced labour.  To support forced labour risk mitigation, companies need to strengthen related procurement processes by including forced labour bidder declarations, qualification requirements and strengthened contractual provision in procurement. As a key recent example, the World Bank has enhanced its Standard Procurement Documents to require its borrowers to strengthen procurements involving solar panels/solar components. The panel will discuss the issues arising in the renewable energy supply chain and ongoing industry efforts to mitigate those risks, and protect the workers globally supporting the energy transition.

Christopher Seppälä, Partner of Counsel, White & Case LLP, Paris, is the Legal Advisor to the FIDIC Contracts Committee and FIDIC's official Observer on the ICC International Court of Arbitration.
He is the author of The FIDIC Red Book Contract: An International Clause-by-Clause Commentary | Wolters Kluwer Legal & Regulatory, 2023.
He acts as independent arbitrator or expert in international arbitrations. He is a former Vice President Emeritus of the ICC’s International Court of Arbitration and a lecturer on international construction contracts at the University Paris 2 Panthéon-Assas.
He is a member of the New York and Paris Bars.
