This Forum is for adjudicators, dispute board members, members of the FIDIC President’s List of Adjudicators, dispute board practitioners and other industry participants who are experienced and knowledgeable in applying dispute avoidance techniques and are active in engineering, construction and infrastructure industry to discuss the latest key global issues in the dispute avoidance and adjudication arena.

Engage with members of FIDIC’s Presidents list of Adjudicators and other dispute board practitioners in enlightening discussions about the most critical issues in the dispute avoidance arena and gain valuable insights on the DAAB role and practical strategies for effective conflict management in construction projects.

The session will focus on discussing Site Visits and the forum will conclude with key takeaways.

In this part of the forum, the participants will be divided into six groups to discuss certain aspects of site visits and provide comments as takeaways to be taken into consideration for future Practice Note.

Conference programme

Day 1 of the conference includes a topical session presenting FIDIC’s Carbon Management Guide for FIDIC Contracts, followed by an important discussion examining the crucial role of the engineer under FIDIC contracts. Drawing on real-world experiences, speakers will examine the responsibilities and practicalities of the engineer’s role while also addressing how these duties are rapidly evolving in an industry undergoing significant change.

The afternoon of day 1 will include a session looking at the global use of FIDIC contracts, with special emphasis on the experiences of users worldwide. Speakers from financial institutions, multilateral development banks (MDBs) and major contractors using FIDIC contracts will share their perspectives on working with FIDIC forms for their projects worldwide. The first day will also include an opportunity to question members of the FIDIC contracts committee, a discussion on the dynamics of sub-contracting and two discussion tables on PPP contracts and the latest case law developments.

The discussion will also highlight the Asian Development Bank (ADB) initiative, which developed a Collaborative O&M Contract for infrastructure projects – primarily focused on water but adaptable to other sectors - based on the 2021 Green Book enhanced with collaborative contract provisions.

Speakers will present FIDIC’s second Practice Note on the appointment of Dispute Boards, alongside exclusive pre-release findings from a global survey conducted by King’s College London. The session will also present UNCITRAL’s new Model Clause on Adjudication, including the possibility of initiating a highly expedited compliance arbitration to enforce the decision of the adjudicator.

The session will also examine common issues and questions Dispute Boards help parties resolve, drawing on practical experiences from various projects.
